Victim Kills His Attacker During Attempted Robbery
Last week in West Park, a man was walking home from a nightclub, early in the morning. Another man put a gun to his head and was going to rob him, but the victim pulled out his own gun and shot the robber point-blank. He killed the robber just inside his apartment complex and immediately called 911. While most people would chalk this case up to a case of self-defense, others are more concerned about the man’s right to carry a weapon. The victim did not have a permit to carry the handgun. However, in a case such as this, gun permits seem to be irrelevant.
The man used the gun to protect himself in what he felt was a life-threatening situation. Even if the attacker had a properly licensed gun, he does not have the right to use it as a murder weapon on an innocent bystander. Therefore, it would appear that the victim’s rights would overpower those of the robber. The trial for this case may be lengthy and complex. The attorney will have to convince the court that the victim was indeed protecting himself- that which the Second Amendment provides for. In situations like these, you need criminal defense experts.
